TikToker Sues Roblox For Allegedly Stealing Apple Dance Choreography

TikTok content creator Kelley Heyer took legal action against Roblox; she is claiming that the company stole her Apple dance choreography. Her dance was performed to the hit single: Apple, created by popular artist Charli xcx. The choreo has since gone viral – starting a dance trend on TikTok.
Heyer’s legal team claims Roblox sold over 60,000 units of the Apple Dance emote, earning $123,000 by selling her choreography as an in-game emote without the original choreographer’s consent.
One of Heyer’s videos has amassed 209 thousand likes on Tiktok – her choreography increased viewership and engagement for Charli xcx’s single.
“As the Apple Dance emote comprises solely of the Apple Dance choreography, completely separate and distinct from the Charli XCX song, the sole ‘artist’ for purposes of the emote is Ms. Heyer,” the legal document reads.
According to Polygon, the two parties were negotiating a potential partnership, but “Roblox released the emote before negotiations were finalized, and they never came to pass.”
“Roblox moved forward using Kelley’s IP without a signed agreement,” attorney Miki Anzai told Polygon.
The dance emote is no longer available for purchase on Roblox – it ceased its sale in November 2024. Other video game platforms, such as Fortnite and Netflix, finalized agreements with Heyer prior to publishing her dance emote.
