Accessories Manufacturer Genki Gets Sued for Its Mockup of Nintendo Switch 2

Nintendo officially filed a legal complaint against video game accessories manufacturer Genki in the United States, in the Central District of California, for the company’s mockup of Nintendo Switch 2, which was presented at CES 2025.
Genki, which is, as of the time of writing, accepting pre-orders for its Nintendo Switch 2 accessories, shared the response to Nintendo’s accusations via X (formerly Twitter), stating that they can’t comment in detail and will share more later.
In its filed accusations, Nintendo states that Genki’s assertions regarding compatibility cannot be substantiated without obtaining unauthorized and unlawful early access to the Nintendo Switch 2. Therefore, Genki has made and continues to make, misleading statements to the public about its ability to ensure its products will work with the Nintendo Switch 2.
In the alternative, according to Nintendo, Genki may have illegally or improperly obtained access to a pre-release version of the Nintendo Switch 2, which would render its compatibility claims factually incorrect and obtained through illicit means.
On top of that, Nintendo highlighted that Genki’s use of Nintendo’s trademarks in promoting its products constitutes unauthorized use that directly competes with Nintendo and its licensed partners’ legitimate marketing efforts for the upcoming console and related accessories.
Nintendo also emphasized the fact that it hasn’t granted Genki any authorization to use its trademarks, including the Nintendo Switch Marks, in connection with Genki’s commercial activities or product offerings. Genki was fully aware of Nintendo’s rights in the Nintendo Switch Marks prior to its use and nonetheless proceeded to use these marks in its advertising and promotional materials.
Moreover, they accused Genki of intentionally reproducing Nintendo’s Nintendo Switch Marks in a fabricated mock-up of Nintendo’s next-generation console, thereby falsely suggesting an association with Nintendo. This conduct was designed to misappropriate the substantial goodwill associated with the Nintendo Switch Marks and deceive consumers into believing there is an affiliation where none exists.
