A joint stipulation filed on Sept. 5, 2025, revealed that Nintendo has won its lawsuit against ModdedHardware website owner Ryan Michael Daly. The stipulation ordered him to pay $2 million and receive a permanent injunction from piracy-enabling activities.
Daly’s website, ModdedHardware, allowed people to send in their Nintendo Switches to be modded, often installing pirated games. Furthermore, the website also sold MIG devices that circumvented Nintendo’s technological protection measures, allowing people to play pirated games on the console.
According to the original lawsuit filed against ModdedHardware, Nintendo warned the company a couple of times, starting in March 2024. It revealed that Daly “agreed, both verbally and in signed writing, to cease his infringing conduct.” Nintendo of America did not file a lawsuit during that time because of the agreement.
However, Daly did not stop ModdedHardware from operating, which led to a final warning written by Nintendo in May 2024. Daly once again ignored the warnings and continued working on ModdedHardware, prompting Nintendo of America to file a lawsuit against him, which he defended on his own without a lawyer.
